NHIS திட்டத்தில் அரசு ஊழியர் ஒருவர் திருமணம் செய்து கொண்ட பின்னர், தனது பெற்றோருக்கு இத்திட்டத்தின் கீழ் சிகிச்சை மேற்கொள்ளக் கூடாதென கூறப்பட்டு வருகிறது.
இதனடிப்படையில் உசிலம்பட்டி டாஸ்மாக் ஊழியரான திரு.எஸ்.வீரபாண்டி என்பவர் தனது தந்தைக்கு மேற்கொண்ட மருத்துவச் சிகிச்சைக்கு NHIS-ல் மருத்துவச் செலவினங்களை மேற்கொள்ள மறுக்கப்பட்டது.
இதனைத் தொடர்ந்து திரு.எஸ்.வீரபாண்டி சென்னை உயர்நீதிமன்ற மதுரைக் கிளையில் வழக்கு தொடர்ந்தார். [W.P.(MD)No.4117 of 2018 & W.M.P.(MD)No.4277 of 2018]
இவ்வழக்கை விசாரித்த நீதிபதி.ஜி.ஆர்.சுவாமிநாதன் மனுதாரர் தனது ததந்தைக்கு மேற்கொண்ட மருத்துவச் சிகிச்சைக்குரிய தொகையை 8 வாரங்களுக்குள் NHIS-ல் ஈடுசெய்து தர உத்தரவிட்டார்.
``The petitioner is working as Salesman in a liquor outlet run by TASMAC. He is a regular employee. He is a member of the Medical reimbursement scheme introduced by TASMAC. The petitioner's father underwent a Lung surgery. When a claim for reimbursement was made, it was denied on the only ground that the petitioner got married and that therefore his father cannot be a beneficiary.```
``This ground of rejection was specifically frowned upon by this Court in W.P.(MD)No.7365 of 2010 dated 26.07.2011. Therefore the order impugned in this writ petition is quashed. The second respondent is directed to process the petitioner's medical reimbursement claim and effect settlement in terms of the scheme announced by the TASMAC for its employees. The medical reimbursement shall be done within a period of 8 weeks from the date of receipt of a copy of this order.```
இதனை எதிர்த்து டாஸ்மாக் நிர்வாகம் சார்பாக தாக்கல் செய்யப்பட்ட மேல்முறையீட்டு மனுவை விசாரித்த நீதிபதிகள் சுந்தரேஷ் & சதீஸ்குமார் அமர்வு தனி நீதிபதி அளித்த உத்தரவே செல்லுமென தீர்ப்பளித்து மேல்முறையீட்டு மனுவை தள்ளுபடி செய்தது.
